Mirza v. Insurance Administrator of America, Inc., et al.

Setting precedent in the Third Circuit, Callagy Law successfully argued that an ERISA plan administrator’s failure to explicitly state, in an adverse benefits determination letter, the contractual time limitation for bringing  a lawsuit results in annulling the contractual time limitation and applying the statute of limitation from the most analogous state-law cause of action—New Jersey’s six-year limitation for breach of contract claims.
